David Rossmiller spoke October 30 at an event offered by the Mississippi-Alabama Sea Grant Legal Program in Biloxi, Mississippi. The program is sponsored by the University of Mississippi. David spoke about the Mississippi Supreme Court’s recent adoption, in Corban v. USAA, of his framework for interpreting property insurance policies in cases where more than one cause of property loss exists. This issue was extremely contentious in thousands of Hurricane Katrina lawsuits. This is the fourth court to adopt David’s interpretation framework, which challenged the conventional wisdom of interpretation of the so-called anti-concurrent cause clause in policies and brought about a reversal of legal and judicial thinking on this subject.
