Oregon Construction Contractors Board Issues Suggested Forms for Moisture Intrusion Notice & Maintenance Schedule
As we reported earlier, new requirements took effect on July 1, 2008 for residential construction contractors in the State of Oregon. Specifically, the 2007 Oregon State Legislature passed House Bill 2654, which requires the Oregon Construction Contractors Board (CCB) to adopt new rules obligating residential construction contractors to provide homeowners with information regarding moisture intrusion, water damages and maintenance.
Recently, the CCB issued suggested forms for a moisture intrusion and water damage information sheet, as well as a maintenance schedule. The forms are available on the CCB's website click here to access. While contractors are free to use their own forms, the CCB's forms should assist contractors in determining what must be included.
While House Bill 2654 also requires the CCB to adopt new rules obligating residential construction contractors to offer homeowners a written warranty, the CCB advised it does not plan on issuing a suggested warranty form at this time. As such, contractors will have to draft their own warranty forms.
As always, we recommend seeking legal counsel when drafting the appropriate forms to be sure your are in compliance with these new requirements.
